The 14th Amendment questions

PLEASE MAKE SURE TO READ IT ALL IF YOU DO HAVE QUESTIONS ASK ME Step 1: Open the handout “U.S.Constitution: Fourteenth Amendment.” Copy these questions into a word processing document titled “14th Amendment Activity.” Type your responses to A and B, then watch the first video clip and respond to question C. In addition, respond to the question: “Why do you think that Supreme Court Justice David Souter has called the Fourteenth Amendment “the most significant structural provision adopted since the original Framing” [of the Constitution]? (McCreary County v. ACLU of Kentucky [2005])

Step 2: Open and print the handout “The Civil Rights Act of 1875 (excerpt)” for your notes. In the same document you created for Step 1, respond to these questions: 1.) What was the environment that created the need for the Civil Rights act of 1875? 2.) What areas get special attention in Section 1 of the Act? 3.) What is prohibited? 4.)What can happen if you violate Section 1? Who might not like this Act?

Step 3: Download the handout “The Civil Rights Cases.” Copy the quotations A through E into your word processing document. Label each quotation “C” or “U” as directed on the handout. Watch the second video segment to find out how the Court decided. After watching the video, what would you say are the key aspects of the Court’s decision in the 1883 Civil Rights Cases?

Step 4: Download “The Fourteenth Amendment and Protection for Workers.” Print this out and write your thoughts on the handout before watching the third video clip. As you watch “Workers Rights,” think about what was happening at the time of the case and the decision that may have influenced the Court’s decision. Take notes in the blank lines on your handout

Step 5: The last video clip explains the context for the West Coast Hotel Co. v. Parrish decision. Notice how attitudes about workers’ rights changed during the depression and the New Deal. In your “14th Amendment Activity” document, respond to the following questions: 1.) Describe the protections offered by the Fourteenth Amendment to the Constitution. 2.) How did the Court apply the Fourteenth Amendment to civil rights cases during the Reconstruction era? 3.) How did the Court back away from enforcing the Fourteenth Amendment at the end of the Reconstruction era? 4.) How did Justice Harlan’s dissents in the civil rights cases of the late 1800s influence future decisions in the Court? 5.) Which social and economic conditions led to an evolution in the Court’s thinking about the Fourteenth Amendment and its relationship to the rights of workers and employers?
